Please read these terms carefully before using Whistl.

Welcome to Whistl. By accessing or using the Whistl mobile application (the "App") or website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and WHISTL TECHNOLOGIES PTY LTD ("we," "us," or "our"). By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Whistl is a digital accountability and gambling blocking tool designed to help users manage their gambling habits. The Service includes:

  • Blocking access to known gambling websites and apps.
  • Location-based alerts for gambling venues.
  • Accountability features connecting you with a partner.
  • Educational resources and progress tracking.

3. Eligibility and User Accounts

3.1 Age Requirement

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Whistl. By using the App, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Subscription Plans

Whistl offers both free and premium subscription plans. Premium features may include advanced blocking, unlimited partner pairing, and detailed analytics.

4.2 Billing and Renewal

Premium subscriptions are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period.

4.3 Cancellations and Refunds

You may cancel your subscription at any time through your Apple ID settings. Refunds are subject to Apple's App Store terms and conditions.

5. User Conduct

You agree not to use the App to:

  • Violate any applicable laws or regulations.
  • Attempt to bypass or disable the blocking features for illicit purposes.
  • Harass, abuse, or harm another person, including your accountability partner.
  • Impersonate any person or entity.
  • Interfere with or disrupt the integrity or performance of the App.

6. Intellectual Property

The App and its original content, features, and functionality are owned by WHISTL TECHNOLOGIES PTY LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location.
  • Any errors or defects will be corrected.
  • The Service is free of viruses or other harmful components.
  • The results of using the Service will meet your requirements.

We cannot guarantee 100% blocking of all gambling sites or venues due to the constantly evolving nature of the internet and physical locations.

8. Limitation of Liability

In no event shall WHISTL TECHNOLOGIES PTY LTD, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
